Caliber & Time is an online marketplace for wristwatches that offers registered users the possibility of contacting and communicating with sellers and buyers of wristwatches and wristwatch accessories worldwide. Caliber & Time offers registered users the opportunity to post listings (advertisements) of the products they have to sell. Caliber & Time also facilitates users to view listings by other users and initiate contact for purchase.

The listing policy of Caliber & Time is a set of rules and guidelines regarding listings (advertisements) of products designed to ensure a better transactional experience for all users. As a condition of use, you undertake not to use the services of Caliber & Time for any purpose that is prohibited by these Terms. You are responsible for all of your activities in connection with the services.

PLEASE READ THESE TERMS CAREFULLY. THE USE OF THE PLATFORM CALIBER & TIME (HEREINAFTER “PLATFORM”) EITHER THROUGH THE WEBSITE OR ANY OTHER ELECTRONIC DEVICE OR ANY OF THE OTHER PRODUCTS, APPLICATIONS, AND SERVICES INDICATES YOUR ACKNOWLEDGEMENT, UNDERSTANDING, AND ACCEPTANCE OF THESE TERMS.

General

User listings on the platform are advertisements by sellers offering products for sale to prospective buyers and are in no way binding on the platform or its users to conclude a sale.
Any and all accords or contractual relationships between users for the sale, purchase, or trade of products will be formed exclusively between users themselves.
The fulfillment of such accords initiated on the platform shall also take place exclusively between users.
Caliber & Time is not a party to such transactions, and has no control over any element of such transactions; as such shall have no liability to any party in connection with such transactions.
Users use the services and the platform at their own risk.

Listing Guidelines

Upon submitting a listing you undertake that you own and hold all necessary rights, title, and license to the product listed by you
The product listed by you (the user) on the platform does not and will not violate or infringe the rights of any third parties, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights
All details with regards to the product listed by you are accurate, complete, up-to-date, and not misleading in any manner way, or form.
Maintain Good Business Ethics. Once a deal is done and the price is agreed upon, please stick to mutually agreed on terms.
No promotions or spam: Members are requested to use the platform for its intended purposes only. Self-promotion, spam, and irrelevant links are not permitted.

Listing Rules

Replicas, fakes, duplicates, first copies, etc are not permitted, and listings of such products may result in immediate termination of access or removal from the platform.
Microbrand and Homage Watches: Good quality microbrand watches and homage watches are permitted.
Caliber & Time is a platform dedicated to the sale, purchase, and trade of wristwatches and wristwatch accessories. Please use the platform for its intended purposes and do not list unrelated products.
Listings may not include any profanity or obscene, indecent, or pornographic material.
Listings should not contain any unauthorized or unsolicited advertising such as spam
Listings should not contain software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or any third party.
Users are prohibited from impersonating any person or entity to list products for sale
Listings should not include anyone’s identification documents or sensitive financial information.

While using the platform users are not permitted to:

Restrict or inhibit any other user from using and enjoying the platform.
Use the platform to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Interfere with or disrupt any servers or networks used to provide the platform or its features, or disobey any requirements, procedures, policies, or regulations of the networks we use to provide the platform.
Use the platform to instigate or encourage others to commit illegal activities or cause injury or property damage or interfere with business interests or contractual relations of any person.
Gain unauthorized access to the platform, or any account, computer system, or network connected to this platform, by means such as hacking, password mining, or other illicit means.
Obtain or attempt to obtain any materials or information through any means not intentionally made available through this platform.
Use the platform to post or transmit any unlawful, harmful, threatening, abusive, libelous, flaming, hateful, offensive (concerning sex, race, religion, or otherwise), defamatory, obscene, vulgar, harassing, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, provincial, national or international law.
Use the platform to post or transmit any information, software, or other material that violates or infringes upon the rights of others, including material that is an invasion of privacy or publicity rights or that is protected by copyright, trademark, or other proprietary rights, or derivative works with respect thereto, without first obtaining permission from the owner or rights holder.
Use the platform to post or transmit any information, software, or other material that contains a virus or other harmful component.
Use the platform to post, transmit or in any way exploit any information, software, or other material for commercial purposes, or that contains advertising.
Use the platform to advertise or solicit anyone to buy or sell products or services, to cease using the platform, visit another competing platform, or make donations of any kind, without our express written approval.
Gather for marketing purposes any email addresses or other personal information that has been posted by other users of the platform.
